I want “ALL” illegals out of our country, Government hands out of Medicare, Social Security, taxes lowered for businesses so we can buy things made in the USA not China! I’m boycotting “made in China” which is hard, seems like EVERYTHING is made in China and I’m sick of it! All I can say is ” God is watching us, how disapointed he must be in alot of people! So sad, history, read your history books, lets learn from mistakes, it’s a no brainer to me and alot of people I know! Amen

This law is unconstitutional — the “welfare” spoken of in Article I, Section 8, of the Constitution did not include (in the definition of the times) healthcare or healthcare insurance. Instead, this section provided for the “general Welfare” of the nation and its citizens as a whole, and meant their safety and security from outside and internal threats to that safety.

Likewise, Medicare, Medicaid, and a whole slew of laws passed since about 1900, are unconstitutional in this sense.

The mechanism for correcting these errors of the legislature are the responsibility of the executive branch and of the U.S. courts. Since the executive did not veto the acts, that leaves the courts.

No court may act “sua sponte;” that is, no court may act on its own without having before it a suit and plea for relief. So, someone would have to bring suit to have these laws declared unconstitutional.

No doubt some of that has been done and many rulings of the lower courts, the appellate courts, and indeed the US Supreme Court have incrementally allowed such laws to stand.

The real puzzle is how to extricate ourselves, as a nation, from the clutch of overweaning governance from the federal level.

One idea is for a group (it will take money) to file a Writ of Certiorari with the U.S. Supreme Court and argue smaller pieces of these laws until they can be dismantled either by court ruling of subsequent legislation that repeals it (not currently likely).

Another is a petition for redress to the legislature (less likely).

Any other ideas?

You are so right. The only thing that keeps me sane is to know that a Half Vast Left Wing of communist infiltrators took ahold of the Democratic Party. It is Communism for the Government to finance Health Care, that is a ‘means of production’ usurped by government. I do not think loyal Americans would get behind this ‘take over’ if they knew about it. It is illegal, Communism is not the form of government required by our Constitution.

The cost of Health Care will go up proportionate to the government involvement. But really, they are running Health Care into the ground, as an industry. Soon Obama’s Plutocratic buddies will buy up all our hospitals cheap (with free money from the Federal Reserve).

Cute, isn’t it. Slave doctors. That ought to be great for Amerikan health care.

I would be happy to proof read for your project, I was proof reader for Briefs that went to the Supreme Court back in 1973. But like I said in earlier Blogs, somebody has to bring the Case. The way I see all this playing out is from a biblical prespective. We coutinue to fight for our rights under the Constitution, keep being a Christian trying to change them one heart at a time. Then if the Lord wants this junk to pass, I would have to say that it is His will. We must remember that God’s will is going to continue and man cannot change it. I am glad of the stimulus incentives, but what about us that can’t buy a house, car, health insurance. There is always a “catch of you have to be qualified…you either make too little or too much.” You have to have the percentage to put down to buy a house. If it takes all you have to pay your bills, how can you have abundunt savings
to put down on a house, etc. PLUS, Social Security people having their yearly increase cut out. At a time when it is so needed…yet they “do it their way.”

Donand, forgive me for disagreeing. But the bible doesn’t state the events of today, being the will of God. This is the will of mankind. The bible reads of the revelation due to man’s freedom of choices which brings on God’s anger. God doesn’t interfere with the consequences man brings on man. Consequences teach. But often kill the lives of the innocent. The mystery of God and the loving reward awaits not necessarily in this world, but the next.

Freedom of choice is a gift from God and the test is not to abuse. Jesus teaches the good qualities all human life has under the freedoms God gave. God has given the ability for all human life to take on that freedom and with the ability to do for oneself as each life is an individual existence.

No man had to choose to go down this road. They still have the freedom of choice to turn things around tomorrow. Some say it is happening because of the words of the bible. It doesn’t matter, it has been foretold. Everything could change for a better tomorrow, if mankind chose it to be.

We still have to fight, as no man has a right to take from anyone what isn’t their’s. And by dishonesty, deception, force the number one thing God’s gift of FREEDOM which covers much.

I don’t believe it is God’s will for man to force all to pay for murder of God’s creation, as a convenience or compromise. Nor is it the will of God to have government take over by force, all of what God gave man, especially the ability to do for themselves. I don’t believe it is God’s Will for us to be conducted under this or any corruption. This demoralizes and undermines God’s creation of human life. As faithful believers in God, through the teachings of Jesus Christ, we have a duty to fight to keep what we are born with and from…freedom. This, I believe, is God’s Will.
